Program Terms & Conditions

Nutrition House Affiliate Agreement: This agreement describes the terms and conditions for participating in the Nutrition House Affiliate Program. The term "Affiliate" refers to you (the applicant), and Nutrition House refers to the owner of the primary website.

The Nutrition House Affiliate Program is administered in part through a 3rd party affiliate company called Refersion and in part through https://nutritionhouse.com/

Upon acceptance to the Nutrition House Affiliate Program, you will be required to work with the Nutrition House team to adhere to a customized, mutually agreed upon posting schedule.

Modification: We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but are not limited to, changes in the scope of available referral fees, fee schedules, payment procedures and Affiliate Program rules. If any of the modifications are UNACCEPTABLE TO YOU, your only recourse is to terminate this Agreement. If you CONTINUE PARTICIPATION IN THE PROGRAM, it will be considered as your acceptance of the change.

Enrollment: To start the enrollment process, you must submit a completed online application. All applications must be reviewed and processed before an affiliate is approved into the Nutrition House Affiliate program. Applicants will be informed of their approval status as soon as possible once their information is reviewed. Processing time is, on average, 1-3 business
days but may take longer.

Affiliate Code: You will be issued a special code and link to track your sales once you are accepted into the Nutrition House Affiliate Program. This code will be unique to you and will allow you to be paid for affiliate referrals. Your discount code will only work on full-price products unless advised differently on a specific situation. 

Commissions: Affiliates will receive a 10% commission per sale for anyone who places an order through the affiliate’s URL or uses their unique discount code. Commissions may change at the discretion of the product publisher. Nutrition House commissions may increase during limited-time special promotions, but they will return thereafter to the regular rate of 10% affiliate commission per sale. For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product ordered through the secure order system. Word-of-mouth referrals will not generate an affiliate commission. Commissions during sales will only be attributed to sales that are made when the customer clicks through qualified Affiliate links or discount code (provided by our team). Affiliates cannot use their own code or affiliate link to make a purchase. Any offences to said the rule would result in immediate suspension and/or termination. A

Payment: Payment will be made 60 days after each sale is made to account for possible returns within our return window. 

Order Fulfillment: Nutrition House will be solely responsible for processing every order placed by a customer via affiliate links or affiliate codes. Affiliates are not authorized to collect payments or sell any Nutrition House listed products from other websites as a "reseller," and no "resale" rights are granted in ANY way. Affiliates are not authorized to sell any of these products on eBay, or other auction sites, or any “Marketplace” site such as Amazon, etc. Affiliates are not authorized to give away samples or copies of any products. Nutrition House will also be solely responsible for all customer service inquiries.. Customers who purchase
products and services through the Nutrition House Affiliate Program will be deemed to be customers of Nutrition House. Accordingly, all rules, policies, and operating procedures concerning customer orders and services will apply to
those customers. We may change our policies and operating procedures at any ime. Prices and availability of our products and services may vary from time to time. Nutrition House policies will always determine the price paid by the customer.

Qualifying Sites: Nutrition House reserves the right to refuse entry into the Nutrition House Affiliate Program to any individual, group, or site based on our content.

Applicants that do not qualify for the Affiliate Program include sites which :

• Promote sexually explicit materials

• Promote violence

• Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age

• Promote illegal activities

• List coupon codes or discounts that were NOT officially provided to them by Nutrition House. You may NOT promote coupon codes you may have found elsewhere online. You may NOT share your discount code with coupon websites. Doing so can result in the termination of your affiliate account and the withholding of affiliate payments for violating our affiliate agreement.

• Infringe or otherwise violate any copyright, trademark, or other intellectual property rights of Nutrition House,  any Partner or other site. If conversions come through a discount code website, they will be rejected for commission payments. 

Permitted Usage: Affiliates are permitted to use marketing materials provided by Nutrition House. Approved affiliates will be provided with a link to access marketing materials. Affiliates grant Nutrition House permission to use their name, photographic and/or video likeness, voice, information concerning the affiliate and statements made or information supplied by the affiliate, each in whole or in part, whether or not such likeness, information of statements was/were used in the current version of the program, in any and all present and future media for the purposes of advertising, publicity and trade, and in connection with these matters the
affiliate hereby releases them and each of them from all liability. The affiliate undertakes not to prosecute or institute proceedings, claims or demands against Nutrition House and hereby releases Nutrition House from all claims and liability relating to images, video or statements of the affiliate.

Prohibited Usage: The following cases are prohibited and are grounds for immediate termination of the affiliate account.

• Affiliates MAY NOT use the Nutrition House logo, logo marks or other Nutrition House website/branding imagery in a header graphic or in any way as to indicate they are officially partnered with Nutrition House or anything other than indicating they are part of the nutrition house Affiliate program

• Affiliates MAY NOT share compensation or bonus information to the general public. This is confidential information. Doing so will result in the termination of your account and legal action. 

• Affiliates MAY NOT promote coupons that were not provided to them personally by Nutrition House. You may NOT promote coupon codes you may have found elsewhere online.

• Affiliates MAY NOT host or promote "coupon stacking" sites where customers may combine coupons to receive additional discounts or promote "coupon stacking" sites where customers may combine coupons to receive additional discounts. 

• Affiliates MAY NOT post negative reviews about Nutrition House in any way, shape, or form, or share compensation information. Violating any of these policies can result in the termination of your affiliate account and the withholding of affiliate payments for violating our affiliate agreement.

Anti-Spam Policy: Nutrition House strictly prohibits affiliates from using spam e-mail and other forms of Internet abuse (including spamming forums, blogs, Twitter, Facebook and other social media outlets) to seek sales. Spam is defined as including, but not limited to, the following:

• Electronic mail messages addressed to a recipient with whom the sender does not have an existing business or personal relationship or is not sent at the request of, or with the express consent of, the recipient through an opt-in subscription.

• Messages posted to Usenet, forums, Twitter, Facebook and message boards that are off-topic (unrelated to the topic of discussion), cross-posted to unrelated newsgroups, posted in excessive volume, or posted against forum/message board
rules. Be conscious of forum rules! If a forum owner or moderator complains that an affiliate has spammed, the affiliate account may be permanently terminated after investigation.

• Content posted on free blog websites for the sole purpose of keyword spamming or comments posted to legitimate blogs that violate the comment policy of the blog owner.

• Solicitations posted to chat rooms or to groups or individuals via Internet Relay Chat or "Instant Messaging" system;

Certain off-line activities that, while not considered Spam, are similar in nature, including distributing flyers or leaflets on private property or where prohibited by applicable rules, regulations, or laws. Nutrition House may undertake, at its sole discretion and with or without prior notice, the following enforcement actions:

• Account Termination: Upon the receipt of a credible complaint, the Nutrition House Affiliate Program manager may investigate the complaint and if necessary, will then terminate the affiliate account of the individual implicated in the abuse. Termination results in the immediate closure of the member and affiliate account, the loss of all referrals, and the forfeiture of any unpaid money on
the account. At Nutrition House's discretion, termination may result not only in being banned from the affiliate program but also from ANY other affiliate programs. If you wish to report a violation of our Anti-Spam Policy, please forward all relevant evidence to our customer service department at [email protected]

Relationship of Parties: Affiliates are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. Affiliates have no authority to make or accept any offers or representations on our behalf. Affiliates will not make any statement, whether on their sites or otherwise, that reasonably would contradict this statement.

Term and Termination: The term of this Agreement will begin when you accept and will end when terminated by either party. Either Nutrition House or the affiliate may terminate this Agreement at any time, with or without cause. Upon the termination of this Agreement for any reason, all licenses granted hereunder shall immediately terminate, and you will immediately cease use of and remove from the Affiliate's website, all links to the Nutrition House websites and all Nutrition House trademarks and
logos, other Nutrition House marks and all other materials provided in connection with this program.

Limitation of Liability: Nutrition House will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, expenditures or data) arising in connection with this Agreement or the Program, even if we have been advised of
the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to the affiliate under to this Agreement.

Disclaimers: We make no express or implied warranties or representations with respect to the Affiliate Program or an affiliate's
potential to earn income from the Affiliate Program. In addition, we make no representation that the operation of the websites or the Affiliate links will be uninterrupted or error-free, and Nutrition House will not be liable for the consequences of any interruptions or
errors. Nutrition House can suspend or change discount values for provided unique
discount codes or links at any time.

Miscellaneous: Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. If any of the provisions of this Agreement are determined by a court to be unenforceable, they shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect. By signing up with the Nutrition House Affiliate Program, you acknowledge that you have read this agreement and agree to all its erms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth
in this agreement.

At Nutrition House, we are committed to protecting your privacy. This Privacy Policy sets out our privacy practices for the Nutrition House website from which you have linked to this policy. Please take the time to review this Privacy Policy carefully, as it tells you how your personal information will be treated by us. By using a Nutrition House website (a “Site”) an 
our services, you unconditionally agree to be bound by this Privacy Policy.  

Nutrition House wants to offer you the best possible internet experience; consequently, additional functions, features, products or services are incorporated into Nutrition House Sites from time to time. This, and our commitment to protecting the privacy of your personal information, may result in periodic changes to this Privacy Policy. As a result, please remember to refer back to this Privacy Policy regularly to review any amendments. Any questions regarding our Privacy Policy should be directed to Nutrition

WHAT DO WE COLLECT AND USE PERSONAL INFORMATION FOR? 

In order to:  
• reply to your enquiries and requests for information;  
• receive and process orders submitted by you;  
• customize the service we provide to you;  
• carry out our obligations in relation to any agreement you have with us;  
• verify your identity;  
• anticipate and resolve problems with any goods or services supplied to
you;  
• carry out market research and tracking of sales data;  
• We send you newsletters, surveys, or other information about our products and
services by post, e-mail, or SMS.  
• We may publish your' before and after' stories on the Site at our discretion
and with your consent.  

We may need to collect and process personal information about you, including your name, address and contact details such as your telephone number and e-mail address. If you place an order with us, we will also ask for your payment details. We may ask you for this information through our Site; certain information is collected automatically, as described later in this Privacy

Certain Nutrition House services (such as web hosting and fulfillment) are offered in conjunction with our service providers. In such cases, we may need to share your personal information with them for the sole purpose of enabling them to provide these
services. Please note that certain services may be unavailable if you do not want to disclose the personal information you are asked for.

LOG FILES / IP ADDRESSES 
When you visit our Site, we automatically log your IP address (the unique address that identifies your computer on the internet), which is automatically recognized by our web server. We use IP addresses to help us administer the Site and to collect broad demographic information for aggregate use. Your IP address is also logged when you make a purchase as a fraud prevention measure required by the payment gateway.

NON-PERSONAL INFORMATION 
We may automatically collect non-personal information about you, such as the type of internet browsers you use or the site from which you are linked to our Site. You cannot be identified from this information, and it is only used to assist us in providing an effective service on our Site. We may, from time to time, supply the owners or operators of third-party sites from which it is
possible to link to our Site with information relating to the number of users linking to our Site from their sites. You cannot be identified from this information.

INFORMATION PLACED ON YOUR COMPUTER 

We may store some information (commonly known as a “cookie”) on your computer when you look at our Site. This information facilitates your use of our Site and helps us understand how it is used. You can erase or block cookies from your computer if you want to (your help screen or manual should tell you how to do this), but certain Dermal Photonics services may not work correctly or at all if you set your browser not to accept cookies.  

To order products on our Site, you need to have cookies enabled.  

If you don't wish to enable cookies, you'll still be able to browse the site and use it for research purposes. However, some of our functionalities may not work correctly if you disable your cookies, so you may need to enable your cookies temporarily to improve your shopping experience.

continue to receive order and account communications from us.

KEEPING OUR RECORDS ACCURATE 
We aim to keep our information about you as accurate as possible. If you would like to review or change the details you have supplied us with, or you would like to remove your published 'before and after' story from the Site, you may
do so at any time by using the "Contact Us" page on this Site.

SECURITY 
You should be aware that the internet is an insecure environment. We have implemented technology and employee policies to help safeguard your privacy from unauthorized access and improper use, including the use of secure server software ("SSL") to encrypt and, therefore, protect ordering information you need to input before it is sent to us.
